Shopkick Program Terms of Service
In this document, we share our Terms of Service (“Terms” or “Agreement”) that all Shopkickers must abide by in order to enjoy the Shopkick App. These Terms are for Shopkick users visiting or joining us from March 13, 2025. For existing Shopkickers, these Terms will kick in on March 13, 2025.
Shopkick, Inc. (along with our parent companies, subsidiaries, and affiliates, referred to as “Shopkick,” “we,” or “us”) is on a mission to be your go-to shopping resource, anytime and anywhere. Our goal is to achieve this through the Shopkick mobile app (the “App”), any of Shopkick’s services (the “Services”), the shopkick.com website, and any other associated websites or pages where our Terms are displayed and accessible (collectively, the “Website”) (together, the Website, App, and Services are the “Shopkick App”).
By downloading the App, accessing, or continuing to use the Shopkick App, you agree to these Terms. These Terms outline your rights and responsibilities as a user (“User,” collectively “Users”) of the Shopkick App. The Terms, including all terms, conditions, and policies referenced here, along with any legal notices published within the Shopkick App, form the entire agreement between you and Shopkick regarding the Shopkick App. If you disagree with any of these Terms or have any concerns about our Privacy Policy, you should not use the Shopkick App.
The Shopkick App.
Your Account
To begin using the Shopkick App, you’ll need to set up an individual user account (“Account”). During this process, we may ask for details such as your name, email address (or Facebook login), phone number, and more to personalize your experience and help you redeem your Shopkick points (“kicks”) for rewards. You agree that all info you provide will be accurate, up-to-date, and complete. Plus, you’ll need to create a password for your Account. Keep this password secret and remember, you’re responsible for any activity that happens under your Account, even if you didn’t authorize it. By accepting the Terms, you acknowledge and agree that your account will not be accessed or used by anyone else.
If your password or Account gets used without your permission, let us know right away. We won’t be held responsible for any loss or damage resulting from not following these guidelines. To create an Account and use the Shopkick App, you must be a legal resident of the 50 United States or the District of Columbia and at least 14 years old at registration. If you’re under 18, you’ll need your parents’ consent since they’ll be responsible for your actions while using the Shopkick App.
Your Access to the Shopkick App
As long as you follow these Terms, you can enjoy the Shopkick App and earn rewards anywhere, anytime! Legally speaking, this means you get a limited, non-exclusive, non-transferable, revocable license to download and install one (1) copy of the App on your device, and access and use the Shopkick App for personal, non-commercial purposes. You agree not to: (i) copy, modify, or distribute the App for any reason; (ii) transfer, sublicense, lease, lend, rent, or share the App, Website, or Services with anyone; (iii) reverse-engineer, decompile, or create derivative works of the App, Website, or Services; (iv) make the Shopkick App's functionality available to multiple users in any way; (v) use multiple accounts on one device; (v) use the Shopkick App unlawfully or against the Terms; or (vi) use, copy, adapt, modify, create derivative works, distribute, license, sell, transfer, publicly display, perform, transmit, stream, broadcast, or otherwise exploit the Shopkick App, except as allowed in the Terms. No other licenses or rights are granted to you by implication or under any intellectual property rights owned by Shopkick or its licensors.

Shopkick Rewards: How to Earn Kicks
Shopkick’s in-app currency is referred to as "kicks," which functions similarly to reward points. You can earn kicks and other rewards through various methods specified by Shopkick, such as walking into physical stores, scanning featured items while in a store (as requested by Shopkick), scanning purchase receipts, and other activities outlined in the Shopkick App. Shopkick reserves the right to change, add, or remove any types of rewards and the methods by which members can earn and redeem kicks or other awards, at any time and without prior notice. All kicks, under all programs, are rewarded on a “first come, first served” basis. There are often limits on the number of times you can earn kicks within specific time periods (daily, weekly, monthly, etc.) for each action and program (e.g., limits on how many times you may walk into a store or scan a product). Eligibility requirements for all programs may change without prior warning. Be sure to check the App or relevant pages within the Shopkick App for the most up-to-date information. Shopkick will not be liable for a failure to award kicks or other rewards under any circumstances, for any reason, including errors in your mobile device or mobile network, failure to complete the actions, failure to follow the stated directions, or inaccuracies or illegibility of the receipt submitted. Shopkick cannot guarantee that participating products will always be available for purchase at the listed locations (e.g., a vendor may pull products from its shelves, or a product may be out of stock), or that eligibility dates will not change without prior warning. Shopkick disclaims all responsibility for any failure to award kicks. By participating in the Shopkick App, you agree that Shopkick is under no obligation to notify you if kicks are no longer available.
Earning Kicks for Online Purchases
The Shopkick App’s online features allow you to earn kicks by making purchases on specified merchant websites displayed within the App. By using Shopkick’s online-purchase feature, you agree to the terms and conditions of each applicable participating merchant, card processor, card network, and/or card issuer (collectively, “Processors”). Additionally, you agree to the terms within the Shopkick App for the applicable Processors and our Terms as detailed herein. If you do not agree to all of the applicable Processors’ terms and conditions, then you may not use our online-purchase feature or earn kicks from this feature. From time to time, Shopkick may not receive valid, complete, or otherwise sufficient data relating to transactions from online purchases. These transactions will be handled by the applicable Processors rather than Shopkick. Under no circumstances will Shopkick be responsible for Processors’ errors, omissions, negligence, reckless or intentional acts, privacy or publicity rights violations, and/or security breaches, including any related notification obligations. Certain online-purchase transactions, or portions thereof, may not be eligible to receive kicks, including but not limited to clearance items, gift cards, tax, and shipping & handling fees. At Shopkick’s sole discretion, entire online-purchase transactions may be determined to be ineligible for kicks or only eligible for partial kicks credit. Rewards from online purchases may not be awarded or used until a specific time period has expired (for example, to account for returns associated with the participating merchant). Typically, this is between 30 and 45 days, but it could be longer, as indicated in the “Kicks Activity” section of the App and Shopkick App. If you make a return, the transaction is invalidated, disputed, or does not settle for any reason, then some or all pending kicks will be decremented from your account, as determined at the sole discretion of Shopkick. If you make a return for cash, store credit, or credit to a different credit card, we will still need to deduct some or all of your pending kicks accordingly. Regardless of our online-purchase offerings, Shopkick shall not be responsible for any online shopping transactions that you make, or attempt to make, using the online-purchase capability of the Shopkick App. For any questions or issues with any such online transaction, please contact the participating merchant, Processors, and/or your card issuer directly.
Kicks for Receipts
Our Kicks for Receipts program lets you earn kicks by using the App’s submission feature and your device’s camera to submit receipts from purchases of selected products and retailers. Shopkick will occasionally announce through the Shopkick App the actions you need to take, including which products and retailers are participating and the store locations where you need to submit your receipt, or whether you need an e-receipt to be eligible to earn rewards. Each action has specific instructions and time limits for when purchases or submissions must be made.
Kicks for Scans
With our Kicks for Scans program, you can earn kicks by using the App’s scanning feature and your device’s camera to scan bar codes of participating products while in eligible stores. Shopkick will notify you through the App or via email about which products are participating and where they can be found. There are limits on how often and how many times you can scan each product within different time frames (daily, weekly, monthly, etc.). There’s a cap on the total number of scans per product across all users; once this limit is reached, you won’t earn kicks for scanning that product anymore. By participating, you agree to let the App access your camera and for Shopkick to review your scans. You also agree to use the App and the Kicks for Scans program only for legitimate scans, following the Shopkick Rules. Make sure to scan products only at the specified stores unless Shopkick directs otherwise. Shopkick doesn’t guarantee that all advertised products will always be available for scanning at listed locations or that bar codes will be correct, so we are not responsible for any failed scans or errors.
Kicks for Walk-ins
You can earn kicks for walking into eligible locations with our Kicks for Walk-ins program. To earn kicks, you need to be physically present at the open, active location, have the App open, and have network reception while accessing the relevant screens in the app. Also, Shopkick must have kicks available in that particular retailer at that time. Please note that there are limits on how frequently you can walk into a store to earn kicks, so always check the App for the latest information.
Redeeming Your Rewards
Who doesn’t love rewards? Shopkick has a variety of shopper rewards to offer! When selecting a reward, be sure it’s exactly what you want because once you redeem your kicks for a reward, the reward becomes final. To claim your reward, simply click on the selected item and follow the provided instructions. Remember, kicks and other awards have no cash value, aren’t your property, and cannot be sold, transferred, or assigned. They can only be redeemed for the rewards offered within the Shopkick App. Shopkick reserves the right to revoke kicks and other awards at any time without prior notice.
Rewards Options
Once you’ve collected enough kicks, you can exchange them for cash, gift cards, or other rewards listed in the rewards section of the Shopkick App. Shopkick periodically updates the list of rewards and may adjust the kick values and redemption criteria at any time. This includes the potential devaluation of kicks and rewards. The frequency and schedule for redeeming kicks or receiving rewards may also be modified. We may set a minimum threshold (for example, $20) in cumulative kicks before you can redeem rewards, which can change over time. Note that Shopkick is not the supplier of any reward and is not liable for its fulfillment, condition, or value. If you have any issues with a reward, please contact the supplier directly. You can use your kicks once you’ve accrued enough to redeem a reward, as indicated within the Shopkick App. Alternatively, you can save your kicks for future use before they expire, are forfeited, or the Shopkick App is terminated. Don’t forget to check the expiration of earned rewards if you decide to accumulate your rewards. Some rewards may require additional time for fulfillment. Refunds, exchanges, and other issues related to the redeemed item are governed by the reward supplier’s terms and conditions, including any warranty, and are not Shopkick’s responsibility. Specific restrictions may apply to certain rewards, and these terms are disclosed through the Shopkick App. Participating merchants in Shopkick can change at any time. You are responsible for any applicable taxes resulting from rewards received as part of the Shopkick App. Rewards pictured within the Shopkick App may not always reflect the exact colors or models due to variations and updates from manufacturers.
Reward Requirements
Certain rewards require a unique code for redemption, such as a “virtual store card.” This unique code might be sent to you via email, directly to your device, or through the Shopkick App. The email will be sent to the address you provide, and you’ll need to present this unique code to a store sales associate to redeem your reward. Once the reward code is sent to you, the redemption process and the store card itself are handled by the store where the card is to be used, and Shopkick is not responsible for the reward value or the redemption process. Other rewards may require an account with the applicable reward provider (such as PayPal, Venmo, etc.), a mailing address for shipping, or other requirements as set forth in the Shopkick App. You are responsible for maintaining accurate information in your account and with the applicable reward provider. You agree to provide any additional information requested by Shopkick to verify your identity and administer your reward. If rewards are not deposited, mailed to you, or cashed by you (e.g., if a check expires) through no fault of Shopkick, we have no obligation to reissue such a reward. Merchandise rewards that cannot be claimed in-store or within the app will be shipped via U.S. mail (or another carrier at Shopkick’s discretion) within six to eight weeks from the date of reward redemption. Merchandise can only be shipped to approved U.S. shipping locations, and some merchandise rewards require a street address for shipment. Shopkick reserves the right to substitute merchandise of equal or greater value if the original merchandise is unavailable, or to refund the kicks redeemed for unavailable merchandise. All rewards in the Shopkick App are provided “AS IS” without any warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To redeem kicks for rewards, you agree to comply with all applicable laws and abide by Shopkick’s rules. Shopkick reserves the right to retroactively reverse any rewards or benefits granted to you for any prohibited conduct or violation of the terms. You agree to cooperate fully and promptly repay any such reversed rewards. If you believe that kicks or other awards were not properly accrued to your account, please notify Shopkick using the “Contact Us” form on the website within 30 days of the error. Allow 30 days for any claims to be researched and corrected as needed. Shopkick’s determination will be final and made at its sole discretion. Unfortunately, we cannot guarantee that kicks or other awards you believe should have been accrued can be credited later if Shopkick cannot determine your precise location or action at the time. Technical issues with the walk-in or scanning system or verification of transaction information may result in your action not being detected or verified accurately by the Shopkick App. While we strive to prevent such occurrences, neither we nor our affiliates or business partners can be held liable for your inability to accrue kicks or other awards in such events.
Modification of the Shopkick App
Shopkick holds the right to modify, discontinue, or terminate any or all parts of the Shopkick App at our sole discretion. This includes making changes to the Terms at any time. For instance, we may introduce a fee for using the Services, devalue accumulated kicks and rewards both retroactively and in the future, or cease the Shopkick App entirely. Any updates will be posted on our Website, Application, via a Message, and by updating the date of the last revision in this Agreement. All revised terms and conditions will take immediate effect from the date they are posted, or as swiftly as permitted, and will apply to all users, whether you have an Account or not. If any part of this Agreement or any change to the Terms, Website, Application, or Shopkick App is unacceptable to you or makes you non-compliant with the Agreement, you must stop using the Services and, if necessary, terminate your account. As outlined here, if you opt out of the Services, Shopkick may forfeit any or all kicks, Rewards, and/or other awards in your Account after the prior notice period. By continuing to access or use the Shopkick App after the changes become effective, you agree to be bound by those changes.
Termination or Cancellation of Your Account
You may terminate your Account at any time and for any reason by deleting your account through the Application or designated pages within the Shopkick App, or by sending an email to Shopkick with the subject line “please cancel my Shopkick membership” to help@shopkick.com and requesting removal from the Shopkick App. Once you cancel your Shopkick Account, it will be terminated, becoming inaccessible, and all kicks, awards, and Rewards will be forfeited. Shopkick will handle any termination request within 30 days of receiving it. We may immediately terminate your Account or suspend your access to the Shopkick App and remove any kicks or material (including User Content provided by you) from the Website, Application, or our servers if you breach the Terms, our policies, or engage in other improper conduct, at our sole discretion and without prior notice. Following such termination, we may disqualify you from future participation in any of our programs, Services, or the Shopkick App. Any suspension, termination, or cancellation will not affect your obligations to Shopkick under the Terms (including but not limited to ownership, indemnification, and limitation of liability), which are intended to survive such actions. Upon termination, all licenses and other rights granted to you under the Terms will immediately cease, and you will forfeit all kicks and other awards accrued. We will not be liable to you or any other person for terminating your Account or suspending your access to the Services. Upon any termination or suspension, any information (including User Content) you submitted to the Shopkick App may no longer be accessible to you. Additionally, we have no obligation to maintain any information stored in our database related to your Account or to forward any information to you or any other person. IMPORTANT: YOUR ACCOUNT MAY BE DEEMED INACTIVE IF YOU HAVE NOT ACTIVELY USED THE APPLICATION FOR 180 DAYS OR MORE. ONCE YOUR ACCOUNT IS CONSIDERED INACTIVE, IT MAY BE TERMINATED AND ANY OR ALL KICKS, REWARDS, AND OTHER AWARDS IN YOUR ACCOUNT MAY BE FORFEITED, WITHOUT NOTICE AND AT SHOPKICK’S SOLE DISCRETION. SIMILARLY, IF KICKS ARE NOT USED OR REDEEMED WITHIN 180 DAYS AFTER THEY ARE AWARDED, ALL SUCH UNUSED KICKS MAY BE SUBJECT TO FORFEITURE, AT SHOPKICK’S SOLE DISCRETION. In conclusion, we aim to make the Shopkick App user-friendly and transparent. Should you have any questions or concerns, please reach out to our support team at help@shopkick.com. We appreciate your understanding and continued use of our Services. At Shopkick, we love helping our community earn rewards for their everyday shopping. To make sure everyone enjoys the benefits of the Shopkick App, we have some important rules in place for our valued users. Here are the guidelines ("Shopkick Rules") that all users need to follow to make the most of the Shopkick App, in addition to our Terms of Service. By using the Shopkick App, you agree to stick to these rules. If any user misuses the Shopkick App, Shopkick will decide, at its own discretion, whether to restrict or ban that user from future use.
As a user, you agree to the following:
- Residency: You must be a U.S. resident; the Shopkick App is open to U.S. residents only.
- Compliance: Follow all applicable local, state, national, and international laws and regulations while using the Shopkick App.
- Honesty in Referrals: Do not misrepresent the value of a referral or promo code to anyone, and don’t encourage others to do so.
- Authentic Purchases: Don’t submit false, inaccurate, fabricated, counterfeit, or tampered purchase information to collect rewards.
- Single Account Use: Maintain only one Shopkick account. If you use multiple devices, you may only collect kicks on only one device at a time.
- Device Sharing: Don’t share your device(s) with other Shopkick users.
Earning Rewards (Kicks):
- Walk-Ins: Earn Kicks for walk-ins by entering a store during open hours with the Shopkick App open, following any limits or restrictions in the app.
- Online Purchases: Kicks are given for completed qualifying online transactions. You will earn kicks for each eligible transaction, but the total number of kicks awarded per transaction may vary. The participating merchant decides if you’ve met the conditions in their offer; Shopkick has no control over this. Disputes must be taken up with the merchant. Shopkick and the merchant aren’t responsible for typographical errors in offers, and Shopkick may correct these errors, with the merchant possibly refunding amounts paid. Shopkick can cancel pending Kicks for fraudulent or deceptive actions.
- Product Scans: Scan the featured product while in a listed store in the app. Scan only items featured for that store and follow any limits or restrictions mentioned in the app. Scan one product at a time and wait between scans for each to be accepted and rewarded.
- Receipt Submission: Submit receipts within ten days of purchase. You can submit up to 20 receipts per month. Only one receipt award per participating merchant per day. Don’t obscure the date on the receipt or upload receipts without a clear date. Avoid creating fake receipts, submitting altered receipts, or receipts for purchases not made by you. Don’t buy products and return them after submitting the receipt for Kicks. If you’re ineligible for receipt Kicks, you won’t earn Kicks on submitted receipts.
- Watching Videos: Earn Kicks by watching videos that specify the number of Kicks to be rewarded. Tap on the video and watch it in full-screen mode to receive Kicks. Watching other videos won’t result in rewards.
- Genuine Redemption: Don’t try to redeem Kicks earned through false or misleading methods (like uploading receipts already used by another Shopkick user or any other schemes to earn Kicks for actions you didn’t take).
- Kicks Transfer: You can’t purchase, combine, or transfer Kicks with other members or any other person. Attempting to do so may lead to disqualification from the Shopkick App and forfeiture of all Kicks in your account.
Inactive Accounts: If a user does not log into the Shopkick App or their Shopkick account for six (6) months or more, the account will be marked as inactive. Kicks from inactive accounts will be forfeited. Shopkick will try to notify you via your registered email address (if you’ve provided one) to inform you that your kicks will be lost unless you log back into the App or your account by a specified date. If you can’t access your account from a Shopkick-compatible device within a 6-month window, please reach out to our support team.
Fraudulent Activity: Any type of fraudulent activity is a breach of Shopkick Rules (and the Terms). Shopkick has the right to take any action it deems necessary against any fraudulent activities, which may include deducting some or all of your Kicks, terminating your account, and pursuing any other legal or equitable actions available to Shopkick. Fraudulent activities include, but are not limited to, creating fake receipts, fake accounts, submitting altered receipts, submitting receipts for purchases not made by you, and/or buying products and returning them after earning Kicks on those specific items.
Promotional Codes (“Promo Codes”): Certain Shopkick users may receive promotional codes occasionally, offering bonus Kicks for completing a specific action. These codes are meant solely for the intended recipients and should not be shared with other Shopkick users. Promo Codes can only be used for their designated purpose and only once unless specified otherwise. Additionally, an individual cannot redeem more than one Promo Code within a 30-day period unless stated otherwise. Shopkick reserves the right to revoke Promo Codes if it believes they have been misused. Promo Codes are valid only within the dates specified in the terms and conditions unless noted otherwise. Promotional offers are subject to change or withdrawal at any time without notice.
This list of Shopkick Rules is not exhaustive. Shopkick prohibits members or any other person from engaging in any activity that Shopkick, in its sole discretion, deems offensive, interferes with the rights of others, or causes harm to any person, including Shopkick and its employees. Violating or acting inconsistently with the letter or spirit of the Shopkick Rules may result in appropriate consequences at Shopkick’s sole discretion, including suspension, cancellation, or termination of the accounts of the offending user, and such violations may result in the forfeiture of any and all Kicks that the user has earned. The preceding sentence does not limit any other remedy, legal, equitable, or otherwise, that Shopkick may pursue.
Shopkick reserves the right to update and change these Shopkick Rules at any time. By following these guidelines, you can ensure a smooth and enjoyable experience with Shopkick.
Content Ownership Shopkick Content
The Shopkick App contains text, software, scripts, graphics, data, pictures, sounds, music, videos, interactive features, user-generated information, editorial, and other content accessible by users (collectively, "Content"). The trademarks, service marks, and logos within the Shopkick App are either owned by or licensed to Shopkick. All Content is owned, licensed to, and/or copyrighted by Shopkick, and you are permitted to use the Content only in accordance with these Terms. Additionally, the Shopkick App features descriptions and potential availability of products for purchase from third parties; however, Shopkick does not control these third parties, so quantity, selection, and price may vary by store location and online. All Content, whether protected by copyright, contract rights, or both, is provided to you AS IS for your information and use as allowed through the functionality of the Shopkick App. We strive to ensure all Content is accurate and complete, but despite our efforts, the Content may sometimes be inaccurate or incomplete, and we make no guarantee that the Content is entirely accurate, reliable, or error-free.
User Generated Content
Certain sections of the Shopkick App may allow you to post or upload text, graphics, images (such as scans or receipts), and other content for display or publication ("User Content"). By submitting User Content to Shopkick, you grant Shopkick a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute copies of, create derivative works of, display, and perform the User Content publicly in connection with the Shopkick App and Shopkick’s business. This includes, without limitation, promoting and redistributing part or all of the Shopkick App in any media formats and through any media channels. User Content you submit via the Shopkick App may be viewed and shared with other people, such as within the Shopkick App or on third-party social networks like Facebook, depending on the settings you choose for your account and/or the settings within the relevant third-party network. Furthermore, any feedback, comments, or suggestions you provide for improvements to the Shopkick App ("Feedback") will be the sole and exclusive property of Shopkick, and you hereby irrevocably assign to Shopkick all of your rights, titles, and interests in and to all Feedback. When submitting User Content, you agree not to: (i) submit material that infringes on anyone else's proprietary rights, including intellectual property, privacy, confidentiality, and publicity rights, or that can be considered spam or junk mail; (ii) knowingly publish false or inaccurate information; (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or that encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) post advertisements, "pyramid schemes," chain letters, or other solicitations; or (v) impersonate another person. Additionally, you agree to abide by the Shopkick Rules. Shopkick does not endorse any User Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with any User Content. We reserve the right to determine in our sole discretion whether User Content is appropriate and complies with these Terms. We may remove such User Content and/or terminate your access for uploading material in violation of the Terms at any time without prior notice. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting, publishing, or otherwise making available User Content or other materials that are believed to violate the Terms or our policies.
Copyright & DMCA Policy.
Shopkick takes copyright laws seriously and expects its Users to follow them as well. Although we cannot always preview or monitor User Content, we may use automated tools to filter, monitor, or delete content that we believe violates our Terms or policies. For instance, we might use these tools to block inappropriate content. We reserve the right to remove or disable access to any User Content that we believe breaches this Agreement, although we are not obligated to do so. Communications Between You and Shopkick
By using the Shopkick App, you agree that we can collect, use, and disclose certain information about you. This information might be provided by you, our service providers, or your friends who invite you to the Shopkick App. We may use this information to contact you via the Website, Application, phone, email, physical mail, or other methods to inform you about updates or additions to the Website, Application, Services, or related products and services. Any such contact is a “Message.” You agree that any electronic Message from us meets any legal communication requirements, including the need for written communication. You may receive various types of Messages on your phone, such as push notifications, text messages, picture messages, alerts, emails, or other messages inside or outside the Application. By agreeing to these Terms and providing your consent, you authorize Shopkick to send texts or calls to your phone using an autodialer or prerecorded voice. We may also offer you the chance to invite friends to download the Shopkick App and use the Shopkick Program. You can invite friends using SMS, email, Facebook, and other communication forms. Depending on your phone’s features, we may suggest content for the message that you can edit. By sending invitations, you represent that the recipients have consented to receive such messages and do not consider them unwanted or unsolicited. You also made the active choice to send these invitations. Generally, you control the settings for the types of Messages and can opt in or out through the Shopkick App or your phone’s operating system. However, this may not apply to infrequent, essential service announcements and administrative messages. Shopkick is not responsible for sending invitation messages; you send these if you choose to invite others. Be aware that messaging fees may apply depending on your wireless carrier’s plan. We do not intend to spam you with unwanted messages. You can opt out of commercial advertising and marketing communications anytime by following the unsubscribe instructions in each communication or by going to your Account page on the relevant Website or Application page to change your preferences. However, we still need to send you specific communications about the Shopkick App and your Account, such as updates to our Terms of Service or Privacy Policy. Our Privacy Policy
By creating an Account and using the Shopkick App, you agree that the Shopkick App may access information about you and your actions, such as videos you watch, surveys you respond to, items you purchase, and other relevant details. Additionally, you agree that the Shopkick App may access your device’s camera and that Shopkick, its vendors, partners, and clients may review the submissions you and your device make. The Shopkick App operates in the United States, and access to it is governed by this Agreement under California and United States laws. By creating an Account and using the Shopkick App, you consent to Shopkick’s storage and processing of your submitted personal data in the United States. You may access your information anytime to confirm its accuracy and keep it current in connection with your Account and use of the Shopkick App. For more information on these practices, please see our Privacy Policy. In summary, Shopkick is committed to respecting copyright laws and expects the same from its Users. We use automated tools to monitor and remove content that violates our policies and reserve the right to disable access to such content. By using the Shopkick App, you consent to us collecting, using, and disclosing certain information about you to keep you informed about updates and services. You can control the types of messages you receive and opt out of marketing communications if you wish. We respect your privacy and handle your personal information per our Privacy Policy.
Third Party Policies
Promotions
Any sweepstakes, contests, raffles or other promotions (collectively, “Promotions”) made available by shopkick may be governed by rules that are separate from this Agreement, but may also include the terms of this Agreement. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with this Agreement, the Promotion rules will apply.
Promotions
If you accessed or downloaded the Application from any app store or distribution platform (like the Apple Store, Google Play or the Amazon Appstore) (each, an “App Provider”), you acknowledge and agree:
- These Terms are concluded between you and Shopkick, and not with App Provider, and that, as between Shopkick and the App Provider, we are solely responsible for the Application.
- App Provider has no obligation to furnish any maintenance and support services with respect to the Application.
- In the event of any failure of the Application to conform to any applicable warranty, you may notify App Provider and App Provider will refund the purchase price for the Application to you (if applicable) and, to the maximum extent permitted by applicable law, App Provider will have no other warranty obligation whatsoever with respect to the Application.
- App Provider is not responsible for addressing any claims you have or any claims of any third party relating to the Application or your possession and use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, we will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms.
- App Provider and its subsidiaries are third-party beneficiaries of these Terms as related to your license of the Application, and that, upon your acceptance of the terms and conditions of these Terms, App Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms as related to your license of the Application against you as a third party beneficiary thereof.
- You must also comply with all applicable third-party terms of service when using the Application.
